s22 POCA Orders

Section 22 of the Proceeds of Crime Act 2022 is a mechanism for the prosecution to seek a ‘reconsideration of the available amount’, i.e. to demand more money be paid by an offender who may have already discharged his/her Confiscation Order, perhaps years earlier.

Roles in Drug Offences

The Sentencing Council’s guidelines on the supply, production, and importation of controlled drugs (“the guidelines”) require that a sentencing court assess culpability by reference to what ‘role’ the Defendant performed in the supply, production, or importation operation.
